Legal, OCI & Citizenship Update

Newsletter June 2026

New OCI Rules, Digital Citizenship Services & Protecting Your Indian Heritage

A review of the most significant developments affecting Overseas Citizens of India, British citizens of Indian origin, NRIs, and families with property, inheritance, and heritage interests across India.

MAJOR OCI & CITIZENSHIP DEVELOPMENTS

Citizenship (Amendment) Rules, 2026 – What Overseas Indians Need to Know

The Government of India has introduced significant changes to the Overseas Citizen of India (OCI) framework through the Citizenship (Amendment) Rules, 2026. These amendments represent one of the most substantial reforms to the OCI system in recent years and are intended to modernise application procedures, strengthen document verification, improve record management, and introduce a more comprehensive digital infrastructure for OCI services.

Among the most significant changes is the introduction of the Electronic Overseas Citizen of India (e-OCI) system, allowing OCI records to be maintained electronically alongside traditional physical documentation. The revised framework also introduces fully digital application procedures, electronic record keeping, revised procedures for renunciation and cancellation of OCI status, and enhanced verification processes.

Key Changes Introduced

Introduction of e-OCI

Under the revised rules, eligible applicants may now be issued with an electronic OCI (e-OCI) registration in addition to, or in place of, traditional paper-based processes. The Government of India will maintain electronic records of OCI cardholders to improve efficiency and verification procedures.

Fully Online OCI Applications

OCI registration, renunciation, acknowledgements, and record management are increasingly being processed through designated online portals. The objective is to reduce paperwork, improve accessibility, and streamline application processing.

New Rules Affecting Minor Children

The amended rules clarify that a minor child may not simultaneously hold an Indian passport and the passport of another country. Families with children who may be affected by dual nationality issues should review their circumstances carefully before making any application.

Digital Record Management

The introduction of centralised electronic records is expected to improve the ability of authorities to verify information and identify inconsistencies between supporting documents.

Bio metric Consent & Enhanced Verification

The revised framework also provides for bio metric consent in certain circumstances and forms part of India's broader move toward digital immigration and identity verification systems.

What This Means for Clients

These developments may have important implications for OCI applicants, existing OCI cardholders, and individuals seeking to establish Indian ancestry or heritage connections.

Greater Scrutiny of Documentation

As applications move into a more sophisticated digital environment, inconsistencies between passports, birth certificates, marriage certificates, historical Indian records, and supporting documents may be identified more readily than under previous procedures.

Increased Importance of Birth & Nativity Records

Individuals who do not possess an official birth certificate may find that additional evidence is required to establish birth particulars, ancestry, or Indian origin. Nativity Certificates and other historical records may therefore become increasingly important in supporting applications.

Greater Emphasis on Documentary Consistency

Applicants should ensure that names, dates of birth, parental details, and other personal information remain consistent across all supporting records. Even minor discrepancies can result in delays or requests for additional evidence.

Earlier Preparation is Essential

Clients are encouraged to review their documentation well in advance of travel plans or application submissions. Historical records, missing certificates, and property-related documentation can often take considerable time to locate and verify.

WHY NATIVITY CERTIFICATES ARE BECOMING INCREASINGLY IMPORTANT

Missing Birth Records? Understanding the Growing Importance of Nativity Certificates

One of the most common challenges faced by Overseas Citizens of India (OCI) applicants and individuals seeking to establish Indian ancestry is the absence of an official birth certificate or other primary records proving Indian origin.

Many families left India decades ago, often before formal birth registration systems were fully established. As a result, applicants may discover that birth records are unavailable, incomplete, damaged, or were never officially registered. In such circumstances, the relevant authorities may require additional evidence to establish an individual's place of birth, ancestry, or connection to India.

A Nativity Certificate is an official document issued by the competent authority in India certifying a person's place of origin or ancestral connection to a particular State, district, or region. In many cases, Nativity Certificates can serve as important supporting evidence where primary documentary records are unavailable.

Nativity Certificates & OCI Applications

The Government of India's OCI guidance specifically recognises Nativity Certificates as one of the documents that may be accepted as evidence of Indian origin in appropriate cases.

This can be particularly important where applicants cannot produce:

  • An Indian passport

  • A birth certificate

  • A domicile certificate

  • Historical municipal records

  • Other primary evidence of Indian origin

Where documentary gaps exist, additional evidence may be required to establish an unbroken chain linking the applicant to a parent, grandparent, or great-grandparent of Indian origin.

Historical Record Tracing & Delayed Birth Registrations

Many individuals born in India before widespread registration procedures were implemented encounter difficulties locating official birth records.

In these circumstances, it may be necessary to conduct:

  • Municipal record searches

  • Village record investigations

  • Revenue record reviews

  • Historical family record tracing

  • School and educational record searches

  • Land and property record investigations

  • Local authority enquiries

These records can often provide supporting evidence necessary to establish identity, ancestry, and place of birth.

How Indian Heritage Services Can Assist

Through our established legal representation and professional support network across India, Indian Heritage Services assists clients with:

  • Nativity Certificate applications

  • Municipal and district record tracing

  • Historical document investigations

  • Ancestral record searches

  • Heritage verification

  • Supporting evidence preparation

  • Government authority liaison

  • Documentary reviews for OCI and citizenship matters

Where records exist, our representatives may assist in locating, obtaining, and verifying documentation from the relevant district, municipality, village authority, registrar, or competent governmental body connected to an individual's place of birth.

Why Early Preparation Matters

Recent developments within the OCI system, including increased digital verification procedures and electronic record management, have resulted in greater scrutiny of supporting documentation.

Applicants are therefore encouraged to begin gathering documentary evidence well in advance of any planned OCI application, citizenship matter, or travel requirement.

The earlier historical records are identified and verified, the greater the opportunity to address documentary gaps before submission.

What This Means For Clients

  • Missing birth certificates do not automatically prevent an OCI application.

  • Nativity Certificates may assist in establishing Indian origin where primary documents are unavailable.

  • Historical records often require detailed investigation and verification.

  • Early preparation can significantly reduce delays and requests for further evidence.

  • Professional assistance can help navigate complex documentary requirements and local authority procedures.

ANCESTRAL LAND & HERITAGE TRACING

Reconnecting Families with Their Indian Heritage,

Property & Ancestral Roots

For many overseas Indians, understanding their family's history extends far beyond genealogy. It often involves tracing ancestral villages, recovering historical family records, verifying ownership of inherited property, and establishing connections to land and assets that may have remained within the family for generations.

As families migrate across the world, historical records can become fragmented, lost, or difficult to access. Important documents relating to births, marriages, land ownership, succession, and family lineage may remain scattered across various government departments, municipal authorities, village offices, revenue records, and family archives throughout India.

Indian Heritage Services assists clients seeking to reconnect with their Indian heritage through professional record tracing, historical investigations, and legal support services across India.

Tracing Ancestral Villages & Family Origins

Many families know that their parents or grandparents originated from India but possess only limited information regarding their ancestral village, district, or State.

Through historical record investigations and local enquiries, it is often possible to identify:

  • Ancestral villages and family homes

  • Historical family residences

  • Migration records

  • Community records

  • Educational records

  • Religious and municipal records

These records can help establish family connections and support citizenship, OCI, inheritance, and property-related matters.

Historical Family Records & Family Lineage Investigations

Family lineage investigations may involve reviewing:

  • Birth and marriage records

  • Municipal registration records

  • School and educational records

  • Electoral records

  • Historical government archives

  • Revenue and land records

  • Family settlement documents

For many clients, reconstructing a family history not only preserves their heritage but also provides important evidence for legal and documentary purposes.

Missing Ownership Documentation

One of the most common issues faced by overseas families involves missing or incomplete property records.

Problems may arise where:

  • Land ownership was never formally transferred

  • Family members migrated overseas

  • Revenue records were not updated

  • Original title documents have been lost

  • Multiple generations have inherited the same property

In such cases, it may be necessary to conduct detailed investigations to establish the property's ownership history and determine the current legal position.

Heritage Record Recovery

Recovering historical records often requires enquiries across multiple authorities and jurisdictions.

These may include:

  • Municipal authorities

  • Revenue departments

  • Registrar offices

  • District administration offices

  • Village Panchayats

  • Educational institutions

  • Religious organisations

  • Historical archives

Where records still exist, obtaining certified copies can provide valuable evidence for heritage, citizenship, succession, and property matters.

Property History Searches

Property history searches can help establish:

  • Historical ownership chains

  • Inheritance patterns

  • Transfers of ownership

  • Encumbrances and disputes

  • Current recorded ownership

  • Revenue record status

For families concerned about ancestral land, inheritance rights, or potential property disputes, a property history investigation can provide valuable clarity before legal action becomes necessary.

How Indian Heritage Services Can Assist

Through our established legal representation and professional network across India, Indian Heritage Services assists clients with:

  • Ancestral village tracing

  • Family lineage investigations

  • Heritage record recovery

  • Historical document searches

  • Property ownership verification

  • Land record investigations

  • Succession and inheritance enquiries

  • Government compliance matters

  • Family asset protection

Every case is assessed individually, recognising that documentary requirements, record availability, and local procedures vary significantly across India's States and districts.

What This Means For Clients

  • Valuable family records may still exist even when believed to be lost.

  • Historical documentation can assist with OCI, citizenship, inheritance, and property matters.

  • Missing ownership records do not necessarily mean ownership rights have been lost.

  • Early investigation can help prevent future legal disputes.

  • Professional assistance can often simplify complex enquiries involving multiple authorities and jurisdictions.

Property Rights & Inheritance

INHE RITANCE, SUCCESSION & FAMILY ASSET PROTECTION

Protecting Family Wealth, Property & Inheritance Rights Across Generations

For many overseas Indians, one of the most significant challenges is ensuring that family assets, inherited property, and legal rights are properly protected and transferred from one generation to the next. Unfortunately, inheritance matters are often overlooked until a family member passes away, at which point missing documentation, unresolved ownership issues, and competing claims can create complex legal and administrative difficulties.

As families become increasingly dispersed across different countries, it is becoming more common for estates to involve beneficiaries living in multiple jurisdictions. This can make the administration of inherited assets considerably more complicated, particularly where property, agricultural land, financial assets, or family businesses remain in India.

Indian Heritage Services assists clients in understanding their inheritance rights, tracing family assets, investigating ownership records, and supporting legal processes connected to succession, probate, and estate administration.

Succession Certificates

A Succession Certificate is a legal document issued by a competent court authorising a person to collect and administer certain assets belonging to a deceased individual.

These certificates are commonly required where:

  • The deceased died without a Will.

  • Financial institutions require proof of entitlement.

  • Government authorities request evidence of legal succession.

  • Multiple family members assert inheritance rights.

  • Assets remain frozen pending verification of beneficiaries.

Obtaining a Succession Certificate can often be a crucial first step in resolving inheritance matters and protecting family interests.

Probate Matters

Where a valid Will exists, Probate may be required to establish the authority of the executor to administer the deceased's estate.

Probate proceedings commonly involve:

  • Verification of the Will.

  • Identification of beneficiaries.

  • Collection of estate assets.

  • Settlement of liabilities.

  • Transfer of ownership to rightful heirs.

Where beneficiaries reside overseas, additional documentary requirements and legal formalities may apply.

Family Settlements

Many inheritance disputes can be resolved through properly documented family settlement agreements.

Family settlements are often used where:

  • Multiple heirs inherit the same property.

  • Family members wish to avoid lengthy litigation.

  • Agricultural land requires division.

  • Property ownership requires clarification.

  • Assets are being distributed among siblings.

A properly prepared family settlement can help preserve family relationships while providing legal certainty for future generations.

Undistributed Estates

A significant number of estates remain unresolved for years or even decades following the death of a family member.

Common reasons include:

  • Missing documentation.

  • Unidentified assets.

  • Overseas beneficiaries.

  • Family disagreements.

  • Unregistered ownership transfers.

  • Lack of succession proceedings.

Undistributed estates can create ongoing uncertainty regarding ownership and may increase the risk of future disputes.

Missing Heirs & Beneficiary Tracing

In some cases, individuals entitled to inherit assets cannot easily be located.

This frequently occurs where:

  • Family members emigrated overseas.

  • Contact was lost between generations.

  • Historical records are incomplete.

  • Multiple branches of a family exist across different countries.

Beneficiary tracing and family lineage investigations can often assist in identifying potential heirs and establishing entitlement.

Protection of Inherited Assets

Inherited assets require active management and protection.

Risks commonly include:

  • Unauthorised occupation of property.

  • Deterioration of vacant assets.

  • Encroachments.

  • Fraudulent transactions.

  • Unrecorded ownership changes.

  • Competing inheritance claims.

Regular review of ownership records and legal status can help safeguard valuable family assets.

Ranjit Singh Sethi

Ranjit Singh Sethi is the founder of Indian Heritage Services (IHS), a legal consultancy committed to empowering individuals of Indian origin around the world to reconnect with their ancestral roots, reclaim long-lost property rights, and navigate the often complex legal frameworks of India, the United Kingdom, and other Western nations.

Born in Glasgow, Scotland, to an Indian father and a Scottish mother, Ranjit was raised at the intersection of two rich cultural traditions. This dual heritage instilled in him a deep appreciation for both Eastern and Western values, and provided him with a rare, balanced perspective on life, identity, and law.

Reflecting on his journey, Ranjit shares: “I’ve taken the best of both worlds and brought them together to create a more balanced, meaningful life experience—both personally and professionally.”

Since moving back to the UK, Ranjit continues to travel regularly to India for court cases. This has kept him closely updated on legal changes and current procedures.

Citizenship plays an increasingly significant role in the future of travel often granting visa-free travel

Through IHS, Ranjit combines lived experience with legal insight to offer others the same opportunity: to rediscover their roots, resolve generational legal matters, and re-engage with their heritage in a way that is both empowering and transformative.

Ranjit’s family moved frequently across the UK as his parents built businesses in various cities. His father was an entrepreneur who bought and sold businesses, instilling in Ranjit a spirit of resilience and adaptability. Eventually, the family moved to India, where Ranjit, who would later follow in those footsteps, not only in business but in legal perseverance.

After locating to India for five years, he immersed himself in the culture, customs, and legal landscape—building a lifelong connection that has defined his mission ever since.

These real-world experiences have equipped Ranjit with a rare and practical understanding of both UK and Indian legal systems, especially where they intersect.

Bridging the cultural gap involves actively working to foster understanding, respect, and collaboration.

Through Indian Heritage Services, Ranjit’s mission is to leverage his lived experience and legal understanding to assist individuals of Indian descent—regardless of background, faith, country of origin, or immigration status—in reclaiming ancestral lands, reconnecting with lost family ties, and ultimately, rediscovering a deeper sense of identity and belonging.

Ranjit holds a deep respect for Sikh teachings, drawing inspiration from their values of justice, service, and integrity. Having been raised within the UK Church of England education system, he understands the unique spiritual and cultural duality that many diaspora individuals experience.

This insight allows him to approach each client relationship with empathy, cultural sensitivity, and genuine care. At its core, Indian Heritage Services is more than a legal consultancy. Under Ranjit’s leadership, it becomes a bridge between generations, a guide through legal complexities, and a compassionate partner on the journey back to one’s heritage.
